Terms of Service
1. Who we are
These terms are an agreement between you and SMH Consulting Group LLC, organized in the State of Florida ("SMH", "we", "us"). They apply when you buy or use an SMH Gold Edge software license.
2. What you are buying
SMH Gold Edge is automated trading software (an Expert Advisor) for the MetaTrader 5 platform. Your purchase is a license to use the software. You are not buying an investment, a managed account, a signal service or any promise of results. SMH does not hold, move or have access to your funds.
3. Eligibility
- You must be at least 18 years old and able to enter a binding contract.
- The software is not offered to, and may not be purchased by, residents or citizens of the United States.
- You are responsible for making sure that using automated trading software is lawful where you live.
- You must hold your own MetaTrader 5 account with a broker. Opening and operating that account is between you and your broker.
4. The license
- Each license covers one MetaTrader 5 trading account. The license is bound to that account number.
- The license is personal to you and may not be transferred, resold, shared or sublicensed.
- You may not copy, modify, decompile, reverse engineer or redistribute the software.
- If you need to move your license to a different account number, contact support. Transfers are handled case by case and are not guaranteed.
5. Delivery
After your payment is confirmed, your license is issued against the MT5 account number you provide, and the software file and installation instructions are sent to the email address used at checkout. Installation is currently performed with the help of the SMH team. The software must run continuously, so it needs a computer or virtual private server (VPS) that stays online. Hosting is your responsibility unless you have separately purchased hosting from SMH.
6. Trading risk
Trading leveraged products such as gold (XAU/USD) involves substantial risk, and you can lose some or all of your capital. The software makes trading decisions automatically based on its settings. Market gaps, broker execution, connectivity problems and software faults can all cause losses. Any figures shown on this site or in demonstrations are illustrative and are not a prediction or guarantee of future results. You decide whether to use the software and how much capital to put at risk.
7. Not advice
Nothing SMH provides, including the software, documentation, support or mentorship, is financial, investment, tax or legal advice, or a recommendation to trade.
8. Broker relationship
If you open a broker account through a referral link on this site, SMH may receive compensation from that broker, including rebates based on your trading volume. You are free to use any compatible broker.
9. Support and updates
Support covers installation, configuration and technical operation of the software, as described on our Support page. Updates may be provided from time to time but are not guaranteed.
10. Refunds
Refunds are governed by our Refund Policy.
11. Suspension and termination
We may suspend or revoke a license if these terms are breached, including sharing, reselling or reverse engineering the software, or if a payment is reversed. You may stop using the software at any time.
12. No warranty
The software is provided "as is" and "as available". To the fullest extent the law allows, SMH makes no warranty that the software will be uninterrupted, error free or profitable.
13. Limitation of liability
To the fullest extent the law allows, SMH is not liable for trading losses, lost profits or indirect or consequential losses of any kind, and SMH's total liability for any claim relating to the software is limited to the amount you paid for your license.
14. Governing law
These terms are governed by the laws of the State of Florida, with venue in Pinellas County, Florida.
15. Changes and contact
We may update these terms. The version in effect when you purchase applies to that purchase. Questions: support@goldedgetrading.com.
